1. Information about the data processing

When you visit, consult or use the services available on this site, the following personal data may be processed: name, surname, information for billing and payment details (VAT number, credit card number, social security number, address, company name), email address, phone number, postal addresses, IP address and navigation data, content of requests sent through our Contact form.

2. Purpose of processing

3. Mode and duration of processing

According to art. 4 n. 1 of GDPR, data processing refers to any operation or set of operations such as collection, recording, organization, structuring, storage, adaptation, alteration, retrieval, consultation, use, disclosure by transmission, dissemination, or otherwise making available, alignment, or combination, restriction, erasure, or destruction performed on personal data, whether by automated means or not.

Your data processed when using our website will be deleted or blocked as soon as the purpose for its storage ceases to apply, provided the deletion of the same is not in breach of any statutory storage obligations or unless otherwise stipulated below.

4. Data Access

For purposes described in art. 2, your data can be communicated to colleagues of Data Controller, as persons in charge of processing, or to third societies (i.e. consultants, insurance companies, credit institutes, etc.) with outsourcing activity for Data Controller.

For cloud services, data can be communicated to third stakeholders based in EU borders or extra EU, complying with limitation in art. 44-50 of GDPR.

5. Data Communication

Without declared consent, (ex art. 24 let. a), b), d) Privacy Code and art. 6 let. b), c) GDPR), Data Controller can communicate your personal data for purposes described in art. 2, to security organizations, officers of justice, insurance companies, and to all subjects requested by law for over-mentioned purposes. These individuals will process data as free controllers, without spreading it.

6. Data Transfer

Personal data are stored in servers, based in EU borders. If necessary, Data Controller can move servers in extra-EU borders; in this case, the controller guarantees full respect of regulations, upon agreements with standard clauses according to European Commission indications.

7. Type of data conferment and consequences of denied answer

The conferment of data for purposes described in art. 2 is compulsory and necessary in order to execute various services, according to contracts with UMBRA CONTROL. If lacking, we cannot assure the requested performance.

8. Third party data, provided by CLIENT

As far as third party data (processed using software products and all means provided by UMBRA CONTROL) are concerned, the CLIENT guarantees that third party have received privacy policy information according to GDPR and Privacy Code, and that third party gave consent for data transfer and processing.

Certainly, for third party data the CLIENT is the data controller, with related duties and responsibility, releasing UMBRA CONTROL from any liability, protest or claim from third party about the processing.

9. Rights of the data subject

According to current regulation described in art. 7 of Privacy Code and art. 15 of GDPR, data subject can request: confirmation of personal data, details about data processing, copy of personal data, updating and correction of data, deleting any type of data if there is no legal premise for processing, revocation of consent; in addition, it is possible to oppose the processing and to limit it during an inspection or complaint step.

When applicable, data subject has the rights described in art. 16-21 of GDPR (Right to rectification, Right to erasure, Right to restriction of processing, Right to data portability, Right to object), and Right to complain to Supervisory Authority.
